The Member of Parliament for South Dayi, Rockson-Nelson Dafeamekpor, says he will test the law and seek to injunct the 5G contract announced by the Minister of Communications and Digitalization, Ursula Owusu-Ekuful, to NextGen InfraCo before the deal processes are completed.
He claims he has information about the deal to form the basis for testing the law on the validity of the transaction.
The Lawmaker, speaking on TV 3 about the deal which was announced by the Sector Minister, said, “It must be subjected to the procurement laws in consonance with the constitution.”
Mr. Dafeamekpor referred to the decision by the government to grant a 5G licensing contract to NextGen InfraCo as “scandalous”. He said it does not qualify as “sole-sourcing”.
The member of Parliament emphasised that the 5G contract “breaches the economic rights of other existing Ghanaian entities”.
He said there is a deliberate attempt by the government to break the monopoly of a mobile telecommunications network by creating another monopoly.
He stressed paragraphs two and three of the Minister of Communication and Digitalization’s statement, noting the emphasis on reducing the dominance of a particular mobile telecommunication network in the market.
Meanwhile, the Director of Legal Affairs of the NPP, Gary Nimako Marfo, in response to Dafeamekpor’s decision to head to court to seek an injunction to halt the deal, urged the need for adequate information about the deal before any move is made.
