Deputy Attorney-General Dr Justice Srem-Sai has warned that allowing the suspension of the criminal trial of Hanan Aludiba and his wife, Faiza Seidu, to stand could make it easier for accused persons to halt court proceedings by challenging the charges against them.
The warning follows an appeal filed by the Republic at the Supreme Court challenging the Court of Appeal’s decision to suspend proceedings at the High Court.
In a Facebook post on Thursday, October 22, 2026, Dr Srem-Sai said the state filed the appeal on Wednesday, a day after the Court of Appeal issued its order.
He argued that a complaint about the charges on a charge sheet should not, on its own, be sufficient grounds to suspend a criminal trial, particularly when the trial court has already dismissed the objections.
“If the Court of Appeal’s decision is allowed to stand, no prosecution will ever be possible, since all it would take for a trial to be suspended is an Accused Person complaining about anything on the charge sheet,” he said.
Dr Srem-Sai maintained that the state’s challenge was based on its position that the law did not support suspending a criminal trial under such circumstances.
The Court of Appeal halted the High Court proceedings on Monday, October 19, pending the determination of Hanan Aludiba’s appeal against alleged defects in the charge sheet.
The defence has raised objections to aspects of the charges brought against the accused persons.
The Supreme Court is expected to consider the state’s challenge to the suspension order. Its decision will determine whether the Court of Appeal’s order stands, while the underlying criminal case remains before the courts.
