Supreme Court Dismisses Kuranchie’s Challenge Against Special Prosecutor’s Office

The Supreme Court of Ghana, has dismissed a lawsuit brought by Kenneth Kwabena Agyei Kuranchie, Editor-in-Chief of the Daily Searchlight Newspaper, challenging the constitutionality of the Office of the Special Prosecutor (OSP).

Mr. Kuranchie had filed a legal action against the Attorney General and the OSP, seeking a Supreme Court declaration that the OSP, established under the Special Prosecutor Act, 2017, violates several provisions of Ghana’s 1992 Constitution. This act empowered the OSP to investigate corruption and related offences involving public officials, politically exposed individuals, and private sector figures.

It’s important to note that Mr. Kuranchie had previously initiated a similar case against the OSP last year, which he later withdrew several months ago before filing the recent lawsuit.

The Supreme Court’s decision to dismiss the case emphasizes the need for the OSP to avoid unnecessary legal distractions and focus on its investigative mandate. After considering Mr. Kuranchie’s withdrawal notice, the court concluded that continuing the case would serve no further purpose.

The dismissal effectively renders Mr. Kuranchie’s latest legal challenge irrelevant, confirming the OSP’s constitutionality and operational continuity in Ghana’s anti-corruption framework.

Mr Kuranchie and his legal representatives have yet to comment on the court’s ruling.
