A California judge has dismissed a sexual harassment and wrongful termination lawsuit filed against Will Smith by violinist Brian King Joseph earlier this year.

Joseph had accused the actor and Treyball Studios Management of wrongfully terminating him from his role on the Based on a True Story tour after he reported an incident at a hotel in Las Vegas in March 2025. In the lawsuit, he alleged that items including a sexual message, wipes, a beer bottle, HIV medication prescribed to another person and hospital discharge papers were left in his room, making him feel uncomfortable.

However, Judge Michael Shultz ruled that the allegations did not amount to workplace sexual harassment under California law. According to court documents obtained by Billboard, the judge said the claims did not demonstrate “a severe and pervasive concerted pattern of harassment” capable of creating an abusive work environment.

The court also found insufficient evidence to support Joseph’s claim that he was dismissed for reporting misconduct. Representatives for Smith had previously denied all allegations, with the actor’s lawyer describing the claims as “false, baseless and reckless.”
