Publish prima facie case against Chief Justice – Martin Kpebu

Private legal practitioner Martin Kpebu has called for the findings of the prima facie case against the Chief Justice to be made public. According to him, in a democracy like Ghana’s, transparency and accountability are critical and must be upheld at all times.

Speaking in an interview on TV3, Mr. Kpebu explained that when a petition is filed for the removal of a Chief Justice, the process and evidence supporting it must not be kept secret. “Transparency is key in a thriving democracy,” he said, referencing the Kpebu number 2 v. Attorney General number 2 case, where the Supreme Court’s decisions emphasised openness, probity, and accountability as pillars of Ghana’s democratic system.

He recalled that the findings in the case involving former Electoral Commission Chairperson Charlotte Osei were published and made public. He stressed that the same standard should apply in the current situation, noting that while no two cases are the same, each must be treated based on its own facts.

Mr. Kpebu noted that, as the Chief Justice holds the highest judicial office in the country, she must be held to the highest standards of accountability. “The moment there are serious allegations showing even a small amount of misconduct, it is important for the Chief Justice to step aside for investigations,” he added.

He further stated that it would be difficult to fairly assess the President’s actions in the case if the Council of State’s advice and other relevant documents remain unpublished. He believes that making the findings public will strengthen confidence in the judiciary and protect the integrity of Ghana’s democracy.
